{"id":20533,"date":"2013-10-10T15:42:34","date_gmt":"2013-10-10T19:42:34","guid":{"rendered":"http:\/\/raleighpublicrecord.org\/?p=20533"},"modified":"2013-10-10T15:42:34","modified_gmt":"2013-10-10T19:42:34","slug":"controversial-oberlin-rezoning-moved-to-full-council","status":"publish","type":"post","link":"https:\/\/theraleighcommons.org\/raleighpublicrecord\/news\/2013\/10\/10\/controversial-oberlin-rezoning-moved-to-full-council\/","title":{"rendered":"Controversial Oberlin Rezoning Moved to Full Council"},"content":{"rendered":"<p>A rezoning application for a property on Oberlin Road has been kicked out of committee for review by the full City Council.<\/p>\n<p>Members of the Comprehensive Planning Committee this week sent the application back to City Councilors for a full vote, despite neighborhood opposition.<\/p>\n<p>The half-acre property on Oberlin Road and Van Dyke Avenue is being <a href=\"http:\/\/theraleighcommons.org\/raleighpublicrecord\/news\/2013\/09\/29\/planning-roundup-new-retail-for-lake-boone-trail-holly-hill-expanding\/\" target=\"_blank\">rezoned<\/a> in order to create more of an urban feel for the property than what is allowed under the current zoning. The possible density of the property will not change.<\/p>\n<p><center><iframe src=\"http:\/\/mapsengine.google.com\/map\/embed?mid=z8C70ZWl5v_Q.kdKAvpBxtYpw\" width=\"640\" height=\"480\"><\/iframe><\/center><\/p>\n<p>The main issue with the rezoning stems from driveway access.<\/p>\n<p>Neighbors on Van Dyke Avenue who have spoken before Council members recently are adamant that driveway access onto Van Dyke be prohibited for any future project.<\/p>\n<p>The problem is that according to city code, the city isn\u2019t allowed to prohibit driveway access. Because the property is on a corner, legally, the developer can put a driveway on Van Dyke Avenue within 300 feet from Oberlin Road.<\/p>\n<p>\u201cThe neighbors have to accept the possibility that it could happen,\u201d said Deputy City Attorney Ira Botvinick.<\/p>\n<p>The location of the driveway will come during the site plan stage, during which city staff will work with traffic engineers to find the best location for the driveways.<\/p>\n<p>But, Planning Administrator Travis Crane said that if there\u2019s no regulatory or engineering reason for staff to say no to the driveway access, \u201cwe can\u2019t say no.\u201d<\/p>\n<p>Councilor Russ Stephenson tried to find a legal way around the code that would satisfy the neighbor\u2019s concerns, including looking at prohibiting driveway access until the entire intersection can be studied and redone.<\/p>\n<p>Today, the intersection is one of many that can get jammed up when drivers try to make left turns either from, or onto, Oberlin Road.<\/p>\n<p>\u201cUntil something can be done about that intersection, they\u2019d like to limit access onto Van Dyke,\u201d said resident Laurie Hall, speaking on behalf of the neighbors.<\/p>\n<p>With no legal way to restrict access onto Van Dyke Avenue, Councilors agreed to let the full Council make a final decision as to whether the application should be scheduled for a public hearing in November.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Neighbors oppose driveway access onto a neighborhood street, but City Councilors aren\u2019t legally able to prohibit it. <\/p>\n","protected":false},"author":24029,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":[],"categories":[15],"tags":[1322,1422,1434],"_links":{"self":[{"href":"https:\/\/theraleighcommons.org\/raleighpublicrecord\/wp-json\/wp\/v2\/posts\/20533"}],"collection":[{"href":"https:\/\/theraleighcommons.org\/raleighpublicrecord\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/theraleighcommons.org\/raleighpublicrecord\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/theraleighcommons.org\/raleighpublicrecord\/wp-json\/wp\/v2\/users\/24029"}],"replies":[{"embeddable":true,"href":"https:\/\/theraleighcommons.org\/raleighpublicrecord\/wp-json\/wp\/v2\/comments?post=20533"}],"version-history":[{"count":0,"href":"https:\/\/theraleighcommons.org\/raleighpublicrecord\/wp-json\/wp\/v2\/posts\/20533\/revisions"}],"wp:attachment":[{"href":"https:\/\/theraleighcommons.org\/raleighpublicrecord\/wp-json\/wp\/v2\/media?parent=20533"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/theraleighcommons.org\/raleighpublicrecord\/wp-json\/wp\/v2\/categories?post=20533"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/theraleighcommons.org\/raleighpublicrecord\/wp-json\/wp\/v2\/tags?post=20533"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
