{"id":20666,"date":"2013-11-20T11:52:07","date_gmt":"2013-11-20T16:52:07","guid":{"rendered":"http:\/\/raleighpublicrecord.org\/?p=20666"},"modified":"2013-11-20T11:52:18","modified_gmt":"2013-11-20T16:52:18","slug":"outdoor-music-permits-delayed","status":"publish","type":"post","link":"https:\/\/theraleighcommons.org\/raleighpublicrecord\/news\/city-council\/2013\/11\/20\/outdoor-music-permits-delayed\/","title":{"rendered":"Outdoor Music Permits Delayed"},"content":{"rendered":"<p>Business owners who recently applied for a special use permit that would allow outdoor amplified entertainment will have to wait a little bit longer. <\/p>\n<p>On Tuesday, City Councilors delayed five evidentiary hearings for special use permits that would let businesses play live or recorded music outside. The delay will allow the Law and Public Safety Committee to work with downtown advocates, businesses and residents to come up with a better application policy. <\/p>\n<div id=\"attachment_20667\"  class=\"wp-caption module image aligncenter\" style=\"max-width: 771px;\"><img loading=\"lazy\" src=\"http:\/\/theraleighcommons.org\/raleighpublicrecord\/wp-content\/uploads\/2013\/11\/noise_public_hearing_sign1-771x511.jpg\" alt=\"noise_public_hearing_sign\" width=\"771\" height=\"511\" class=\"size-large wp-image-20667\" srcset=\"https:\/\/theraleighcommons.org\/raleighpublicrecord\/wp-content\/uploads\/2013\/11\/noise_public_hearing_sign1-771x511.jpg 771w, https:\/\/theraleighcommons.org\/raleighpublicrecord\/wp-content\/uploads\/2013\/11\/noise_public_hearing_sign1-336x223.jpg 336w, https:\/\/theraleighcommons.org\/raleighpublicrecord\/wp-content\/uploads\/2013\/11\/noise_public_hearing_sign1.jpg 1050w\" sizes=\"(max-width: 771px) 100vw, 771px\" \/><\/a><p class=\"wp-media-credit\">Karen Tam \/ Raleigh Public Record<\/p><\/div>\n<p>Although noise is a point of contention between businesses and residents, the evidentiary hearing itself is also prompting complaints from both groups. <\/p>\n<p>\u201cThe residents weren\u2019t happy because it was an evidentiary hearing,\u201d said Councilor Mary-Ann Baldwin at <a href=\"http:\/\/theraleighcommons.org\/raleighpublicrecord\/news\/2013\/11\/13\/one-agreement-on-noise-permits-process-doesnt-work\/\" target=\"_blank\">last week\u2019s Law and Public Safety Committee meeting<\/a>. \u201cThe merchants weren\u2019t happy because it automatically pitted them against residents.\u201d<\/p>\n<p>Evidentiary hearings are quasi-judicial hearings, which turns the City Council into a judicial body. There are lawyers, evidence and witness testimony associated with it.
