{"id":21071,"date":"2014-02-19T16:09:44","date_gmt":"2014-02-19T21:09:44","guid":{"rendered":"http:\/\/raleighpublicrecord.org\/?p=21071"},"modified":"2014-02-19T16:09:44","modified_gmt":"2014-02-19T21:09:44","slug":"future-of-oakwood-house-in-limbo","status":"publish","type":"post","link":"https:\/\/theraleighcommons.org\/raleighpublicrecord\/news\/2014\/02\/19\/future-of-oakwood-house-in-limbo\/","title":{"rendered":"Future of Oakwood House in Limbo"},"content":{"rendered":"<p>A prominent Raleigh architect could be forced to tear down his new, modernist home in Oakwood.<\/p>\n<p><a href=\"http:\/\/www.louischerry.com\/blog\/2014\/1\/21\/516-euclid-street-the-house-heard-round-the-world\" target=\"_blank\">Louis Cherry<\/a> began building his new home at 516 Euclid St. in December, three months after receiving a Certificate of Appropriateness from the Raleigh Historic Development Commission.<\/p>\n<aside class=\"module align-center full type-aside\"><strong>Certificate of Appropriateness<\/strong><br \/>\nCertificates of Appropriateness are required before any renovation or construction can be done in a historic district. The certificate is issued by the Raleigh Historic Development Commission.<\/aside>\n<p>Last week, the Board of Adjustment voted 3 to 2 to reverse that decision in response to neighbor Gail Weisner\u2019s appeal, filed in October. Any construction on the house must stop.<\/aside>\n<p>Cherry, whose home is still under construction, can legally continue to work on the house until the Board of Adjustment makes its findings official next month. Once the board certifies its findings, however, construction must stop.<\/p>\n<p>Cherry has the option to appeal the board\u2019s decision to the Wake County Superior Court.<\/p>\n<p>City Attorney Thomas McCormick told the Record if Cherry doesn\u2019t file an appeal, he will be required to bring the house into compliance with a new Certificate of Appropriateness. If that can\u2019t be done, the house will need to be torn down.<\/p>\n<p>McCormick said that Cherry was notified of the appeal, but continued with construction at his own risk.<\/p>\n<p><strong>Council Involvement<\/strong><br \/>\nLegally, the City Council can\u2019t overturn a decision made by the Board of Adjustment. It can file its own appeal with the superior court, which McCormick said the city won\u2019t do.<\/p>\n<aside class=\"module align-left half type-aside\">\n<aside><strong>Community Meeting<\/strong><br \/>\nOakwood residents this week received a flier in their mailboxes informing them of a community meeting about the Euclid House.
